Terms of Use

1. Agreement to these terms

These Terms of Use (the “Terms”) are an agreement between you and Tanwa Technologies Inc. (“Tanwa Technologies,” “TanwaFX,” “we,” “us,” or “our”). By accessing or using tanwafx.com (the “Site”), you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Site.

2. TanwaFX is under development

The Site currently provides information about a proposed peer-to-peer currency-exchange marketplace and allows interested people to join an early-access list. TanwaFX is not currently offering or providing foreign exchange, payment, remittance, custody, escrow, banking, investment, brokerage, or other money services through the Site.

Joining early access does not create a customer, fiduciary, advisory, agency, or other financial-services relationship. Nothing on the Site is an offer, recommendation, guarantee of availability, or invitation to enter into a transaction.

3. Eligibility

You must be at least 18 years old and legally capable of agreeing to these Terms. You may use the Site only where doing so is lawful. Future TanwaFX services may have additional eligibility, identity-verification, geographic, compliance, and account requirements.

4. Acceptable use

You agree not to:

• use the Site for unlawful, fraudulent, deceptive, or abusive purposes;
• submit false information, impersonate another person, or interfere with another person’s use of the Site;
• probe, scan, disrupt, overload, or attempt to bypass the security of the Site or its service providers;
• introduce malicious code or use automated tools to scrape or access the Site without our permission; or
• copy, modify, distribute, or commercially exploit Site content except as permitted by law or with our written consent.

5. Early-access communications

If you join the waitlist, you authorize us to send the product updates and early-access communications described at the point of signup. You may unsubscribe at any time using the link in an email or by contacting privacy@tanwafx.com. Joining the waitlist does not guarantee access to any product, feature, launch date, rate, transaction, or service.

6. Intellectual property

The Site, TanwaFX name and branding, designs, text, graphics, software, and other content are owned by or licensed to Tanwa Technologies and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive right to access the Site for personal, lawful use. No other rights are granted.

7. Third-party services and links

The Site uses or may link to third-party services, including Brevo and Google reCAPTCHA. Those services are governed by their own terms and privacy practices. We do not control third-party websites or guarantee their availability, security, or content.

8. No financial or professional advice

Site content is provided for general information only. It is not financial, investment, tax, legal, accounting, foreign-exchange, or other professional advice. Currency markets and cross-border transactions involve risk. You should obtain independent advice appropriate to your circumstances before making a financial decision.

9. Disclaimers

To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We do not warrant that the Site will be uninterrupted, error-free, secure, accurate, or suitable for a particular purpose, or that any proposed feature or service will be launched.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Tanwa Technologies and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunity, arising from or connected with the Site.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

11. Changes and availability

We may change, suspend, or discontinue any part of the Site and may update these Terms as TanwaFX develops. Updated Terms will be posted here with a revised effective date. Your continued use after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws rules. Subject to any rights you may have under applicable consumer-protection law, disputes will be submitted to the courts located in Alberta.

13. General

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a corporate reorganization, financing, sale, or transfer of the business.
